Terms and Conditions for AVABRITTEN

Welcome to AVABRITTEN ("we," "us," or "our"), a skincare brand committed to providing high-quality, safe, and effective skincare products. These Terms and Conditions ("Terms") govern your access to and use of our website (www.avabritten.co.in or any affiliated sites), mobile applications, online store, and all related services (collectively, the "Platform"). By accessing, browsing, or purchasing from the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

These Terms incorporate our Privacy Policy and any other policies referenced herein. These Terms apply specifically to users in India and comply with applicable Indian laws, including the Information Technology Act, 2000, Consumer Protection Act, 2019, and relevant e-commerce regulations.

1. Eligibility

You must be at least 18 years old or the age of legal majority in your jurisdiction to use the Platform.
By using the Platform, you represent that you are legally capable of entering into binding contracts and are not barred from using our services under applicable law.

2. Account Registration

To place orders or access certain features, you may need to create an account. You agree to provide accurate, current, and complete information during registration and to update it as needed.
You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately at support@avabritten.co.in of any unauthorized use.
We reserve the right to suspend or terminate accounts for violations of these Terms.

3. Products and Orders

Product Descriptions: We strive for accuracy in product descriptions, images, and specifications. However, we do not warrant that descriptions are error-free. Products may vary slightly due to manufacturing processes.
Pricing: All prices are in Indian Rupees (INR) and exclude taxes unless stated otherwise. We reserve the right to correct pricing errors.
Order Acceptance: Placing an order does not guarantee acceptance. We may refuse or cancel orders for reasons including product unavailability, pricing errors, or suspected fraud. You will be notified via email.
Payment: Payments are processed securely via authorized payment gateways. Accepted methods include credit/debit cards, net banking, UPI, and wallets. All transactions comply with RBI guidelines.
Taxes and Duties: GST and other applicable taxes will be added at checkout. You are responsible for any customs duties on international shipments (if applicable).

4. Shipping and Delivery

Shipping Policy: We deliver across India via reputable couriers. Standard delivery times are 5-10 business days, depending on location. Express options may be available.
Shipping Charges: Calculated at checkout based on location and order value. Free shipping may apply on orders above a minimum threshold (e.g., INR 999, subject to change).
Risk of Loss: Title and risk of loss pass to you upon delivery to the carrier.
Delays: We are not liable for delays due to force majeure, courier issues, or incorrect addresses.

5. Returns, Refunds, and Exchanges

In compliance with the Consumer Protection (E-Commerce) Rules, 2020:

Return Window: 7 days from delivery for unused, unopened products in original packaging.
Eligible Items: Most products qualify, except personalized, hygiene-sensitive items (e.g., opened creams, masks), or final-sale items (clearly marked).

Process:

Contact support@avabritten.co.in with order details and photos.
Receive a return authorization and prepaid label (if applicable).
Ship back within 3 days of authorization.

Refunds: Processed to original payment method within 7-10 business days post-inspection. Shipping costs are non-refundable unless due to our error.
Exchanges: Available for size/color issues, subject to availability.

6. Product Use and Safety

Skincare products are for external use only. Perform a patch test before full application.
Discontinue use if irritation occurs. Consult a dermatologist for skin concerns.
We comply with best standards and Drugs and Cosmetics Act, 1940. Products are not intended to diagnose, treat, or cure any medical condition.

7. Intellectual Property

All content on the Platform (trademarks, logos, images, text) is owned by AVABRITTEN or licensors and protected under Indian copyright and trademark laws.
You may not reproduce, distribute, or create derivative works without written permission.

8. User Conduct and Prohibited Activities

You agree not to:

Use the Platform for illegal purposes.
Post harmful, defamatory, or infringing content.
Attempt to hack, overload, or disrupt the Platform.
Violate any applicable laws.

9. Disclaimers and Limitations of Liability

AS IS Basis: The Platform and products are provided "as is" without warranties of merchantability or fitness for a particular purpose.
Limitation of Liability: To the fullest extent permitted by law, our liability is limited to the order value. We are not liable for indirect, incidental, or consequential damages.
Indemnity: You agree to indemnify us against claims arising from your misuse of the Platform.

10. Termination

We may terminate or suspend access to the Platform at any time for violations, without notice or liability.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Kottayam, Kerala.
